I would like to trade a 30' easement across my property to a river for a piece of property elsewhere and have been told by the County that the easement doesn't meet the codes necessary to be recorded in the county records as such but that there was nothing they could do about us having a contract between us accomplishing the same thing. What I'm wondering is if there is any way we can record this contract so that at any time future generations would be able to verify the exact description of the easement along with any restrictions that would be on it?
Hi greierson!
Welcome to forums!
This is something which your attorney will able to answer best. You should contact an attorney and check out whether or not you can record the contract at the county recorder's office.
Feel free to ask if you've further queries.

First of all, you haven't mention on what country are you from. Countries do vary in terms of their policy. However, if you want the best advise to be given unto you, you have to seek for a legal advise in your country.

He hasn't mentioned the country because the Lenders affiliated with this website are exclusively from the United States, so by default all of us assume the questions are about property in the United States. If a consumer asks a question about property not located in the United States, they generally let us know when they ask the question.

Is the property for which you're trading that same that is getting the easement? There is a problem with giving an easement to yourself -- i.e. where you own both parcels. If this is the case, escrowing a deed might work but see a title agency (they will have staff attorney)
