Deceased Estate

Posted on: 23rd Sep, 2008 05:57 am
My mother passed in 2001 and I took the responsibility of probating the deceased estate. There was no will and 4 heirs, myself included. I was advised by a probate lawyer to keep the house in probate as long as possible. We are in a high property tax area (Detroit, MI) and the taxes would multiply considerably upon reassessment.

Fast forward to 2008. The property is still in the estate and a judgment lien for a previously unknown debt (~$14,000) has been placed against the title.

Can this judgment be overturned since there was no claim made by the creditor during the time of the original notice to creditors published in a legal newspaper?
Hi Chewy!

Welcome to Forums!

I don't think that a judgment can be overturned. You can consult an attorney who deals with such issues. He/She will be able to guide you in a better way.

Feel free to ask if you have further queries.
