I used to be on our HOA board. I wound up doing the treasurer's duties for awhile and gave him all of the receipts when he took over again. He lost some of the receipts, and now I'm being accused of withdrawing money for my own purposes. At this point they have not been successful in trying to get the money back using law enforcement, so they filed a civil suit against me. The title is held in both of our names, but it is held in joint survivorship. I was not a co-borrower. If they win their suit, can they put a lien on our home?
Hi lklinden,
It looks like if they win their suit they can put a lien on the property as you are included on the title. But, to be on the safer side, I think you should consult this with a lawyer and ask him about it.
