Abandoned property on lease?

Posted on: 12th Dec, 2009 01:53 am
My aunt has a lot that she leases out in the state of PA. The tenants had thier mobile home on it but were in default of their lease; My aunt decided not to renew their lease & sent them sufficient notice but the tenants did not move; their lease terminated 12/31/08. My aunt took the matter to magistrate court & the magistrate ruled in my aunt's favor; the tenants said they were going to fight it & take it to a higher court, BUT instead they abandoned their mobile home after having stripped it bare of doors, wiring, fixtures, plumbing, etc. My aunt returned to the courthouse to find out what could be done & was told that the mobile home now was the property of the state because the tenants had not paid their taxes. My aunt was told she couldn't do anything with the mobile home because it was not hers. The mobile home is worthless & unsaleable, my aunt is losing income as she is not able to lease the lot. How does she go about having it removed from her property? Can she somehow request or force the state to remove it since they now claim to own it?
Hi treasures2treasure,

Your aunt should contact a real estate attorney and take his opinion in this regard. He will let her know what steps she needs to take in order to remove the mobile home from her lot or force the state to remove it from her property.

Thanks
