Abandonment of mortgage

My mother passed away leaving no will to my brother and I. We are both estate represetives and neither one of us can afford the home.

I have had her property up forsale for 2 months and in this economy everyone is looking to low ball, her property is worth 70,000. All her bills have been paid.

Can I let her property go back to the bank with out it hurting me or my brother since we are not on title or the mortgage?

Hi Guest,

As your name and your brother's name is not mentioned on the mortgage and property deed, you can let the lender foreclose the property. It won't affect you or your brother's credit report.
