MY FATHER OWES AMEX AND CAPITAL ONE A LOT OF MONEY AND HE HAS NO MONEY EXCEPT FOR SOCIAL SECURITY. THESE DEBT WERE INCURRED YEARS AGO AND HE HAS RUN OUT OF MONEY AND BY PAYING THE MINIMUM PAYMENT HE ONLY PAYS THE INTEREST. IT'S A WASTE OF MONEY. IF HE DOESN'T PAY IT, AND HIS SS CHECK IS DEPOSITED INTO MY ACCOUNT WHICH HE WITHDRAWS FROM, CAN THIS ACCOUNT BE GARNISHED? HIS NAME ISN'T ON IT.

As your father's name is not mentioned in your account, his creditors won't be able to garnish your account. Moreover, they won't be able to garnish social security checks as it is exempt from garnishment.

ALNY, your dad can contact Social Security directly to get assistance in preventing any lenders from garnishment as well.

No, this account cant be garnished. This is because social security benefit is exempt from garnishment. Your father can send a letter to the creditors regarding this matter. He can also enclose the documents with the letter to prove that social security benefit is his only source of income.

Again, contacting Social Security Administration directly will cease all such collections activity. The SSA can and will prevent creditors from attaching anyone's benefits.

And I say that telling your creditor(s) to leave the money alone because it's Social Security is like talking to a wall. They won't listen to what you have to say; after all, they want their money back.
