I am currently living in a home for 15 years, the owner died in July 09 which was family I have called the mortgage company to inform them that the person on the mortgage died and to see what I can do as far as getting my husbands name on the mortgage since he is only on the deed...........they told me i could fill out assumption paperwork in that time they sold the loan to chase who is impossible and states they never received assumption paperwork from Washington mutual so I asked for them to send out the paperwork I have been making payments until the loan officer from chase told me to walk away that the house is under water and I couldnt qualify for a conventional mortgage and that the terms of the loan had to stay the same now i havent been making payments and live in Michigan with my husband being on the title will he have rights to assume the mortgage even though we just got foreclosure paperwork? currently 3 months behind will be 4 soon............please help as i stated we are in michigan and will this go through the normal foreclosure process? is it to late to try to assume by credit is better than last year when washington mutual said i only qualified for fha

though your husband's name is on the property deed, it would be completely the lender's discretion whether or not he would let him assume the loan or refinance it. as there is no equity in the property, your husband will not be able to assume or refinance the loan. nevertheless, you should negotiate with the lender once again in order to find out if they can help him in assuming the loan.

chase refuses to talk to anyone i took the death certificate to the local branch and she contacted the research department and faxed a copy of the death certificate and asked for the assumption paperwork to be sent to the home as we still live in it, and my hubbys name is on the deed only i waited a month and received nothing...........i went back down to the local branch and was told there was nothing they could do in the office to call the reasearch department i called the research department and told me i had to mail a hard sealed copy of the death certificate i did so and now time is going by i have made 6 payments this year but apparently the loan is extrememly behind

I can understand that you're going through a tough time. I would suggest you to keep in touch with the research department of the bank and ask them to speed up the process so that you're able to assume the loan.
