Loan modification attorney

i am currently living in a home i paid $420k and now is valued near $180k.
my payment has grown to $3300 and am now struggling to make payments. i purchased this house with my brother and girlfriend (now wife) in 2006 with zero down and 2% interest for the first year. my neighbor gave me a number to an attorney who specializes in loan modifications. i scheduled an appointment to discuss the loan and here are a few things that i could not believe he suggested.

1. falsify divorce paperwork (claim wife walked away)
2. falsify bankruptcy paperwork (clear outstanding truck note $700 per month)
3. falsify brother's (bankruptcy)
4. falsify medical records to show hardship

he claimed the banks do not verify such paperwork and he guaranteed success.
i choice not to go with his agency however, he continues to call asking for a fee for the consultation.
what if any recourse do i have to successfully and legally obtain a modification.

I do not agree with what the attorney has said and it's good to know that you chose not to go with his services. Many a times loan modification companies can scam the borrowers which in turn can create further problems for them.

It is always better to contact your lender and apply for loan modification with the help of a hardship letter. The lender will let you know whether or not he would accept your request.

Not only would I walk away from that attorney I would report him that is all out FRAUD, and you can bet the bank will check EVERYTHING. He needs to have his practice exposed.

Thank you both. I feel comfortable now telling him I will not pay him for his consultation. I have a neighbor that has hired him even after knowing that what he is doing is wrong, illegal and immoral.

steven i certainly hope you "feel comfortable." you ought to be downright aghast at what he requested and you truly ought to report him to whatever body regulates your state's lawyers. and if he calls you again, tell him precisely what you're prepared to do. it's an outrage that he calls looking for payment for being fraudulent.

and your neighbor is fool enough to follow him? i suspect the neighbor is going to be in for jail time if he goes ahead and tries to defraud his lender, no matter whether the lawyer advised him or not. he ought to know better.

Thanks everyone for all your kind advice, I find it difficult to understand how many scams, as well as desperate homeowners willing to do the "wrong" thing and follow such advice. I spoke with my neighbor regarding this matter and he stated "when other homeowners are out in the street we will still have a home".

A quick update: my two neighbors that submitted falsified documents both claim they got their modifications approved. My modification, I am told is still in limbo.
In today's economy I find the more irresponsible one is, the more help available.
