awaiting loan modification approval

I fell behind on my mortgage secondary to loss of income. MY MORTGAGE company called me in September 2009 ( I had late payments but none more than 30 days) and offered me a modification in September 2009. They initially told me since I was having a little difficulty that they would give me a break and start my payments in 2 months. I called in December to make a payment and was told I was 3 months behind now and the modification did not go thru.. The modification did go thru in February 2010. I began the modification program and was on my last payment in the trial period and my loan was sold and the modification application process started all over and they have now sent it to foreclosure attorneys. I now make significantly more and according to the new loan company, I do not qualify for the loan modification program secondary to my income. I don't have a response yes or no to the modification but my Foreclosure date is September 7th. I just need to be able to restart payments and keep getting instructed to wait out the modification. I have some of the money but not 10 months however I can repay it within 6 months....I have been repeatedly told to wait SINCE December 2009 and not make payments because it will not go toward my mortgage. I am so frustrated. Any help will be greatly appreciated. I have been able to pay and have been repeatedly told if I do not have the entire amount that it would not go toward the mortgage. I am awaiting approval on a loan modification and have been told that I make too much an that my interest rate will probably be higher than my rate currently of 6.75%. I have been thinking about suing the INITIAL Mortgage company for fraud. Any help with be greatly appreciated.

Welcome to forums!

As you had applied for a mortgage modification with your lender, you should contact them in order to find out whether or not your request has been accepted. If your request for modification has been rejected by the lender, then he can start the foreclosure procedure. I don't think you would be able to sue your initial mortgage company for any fraud.

It has not be rejected. I have been calling them everyday since I received the notice from the Foreclosure attorneys as well as a sale date. SLS keeps telling me "not to worry" They have had a lot of modifications and it is taking time to get final answer. If they do not have the final answer, they will post pone the foreclosure. They have misled me so badly I just dont trust them. What to do? I can pay. Do I need to spend thousands of dollars for a real estate attorney to speak on my behalf? I want to use that money to catch up my mortgage.

Hi gldmd,

If you can pay the dues, you should let the lender know about it. This might influence his decision to give you a loan modification. He might take quick steps to modify your loan and give you a better payment plan to pay off the loan.
