Judgment after bankruptcy

Posted on: 30th Jan, 2013 12:18 am
Hi there… I filed bankruptcy early last year and was discharged in May. In the bankruptcy, I included a car loan but did not reaffirm the loan. Made some payments but was unable to continue. I was told that since I did not reaffirm the loan and the loan was included in the bk a repossession will not show up on my credit report. My bankruptcy lawyer said I could call and have them come get the car or let them come get it because either way will not affect me. Yesterday they came to my job looking for the car but the car was actually home since I got a ride to work. The repo guy said there was a judgment issued for the car which I was not aware of at all but did tell him that he was more than welcome to pick up the car after I got home but no one came. Can this judgment affect me even if the loan was discharged?
Hi Koli,

If the car has been discharged in your bankruptcy filing and if you haven't reaffirmed the loan, then there cannot be any judgment on that debt. You can get in touch with your bankruptcy attorney and try to check out the matter.

Take care

Hi Koli!

Welcome to forums!

If you haven't reaffirmed for the loan, then you are not personally liable for the debts. In such a situation a judgment cannot be filed against you for such a debt.

Feel free to ask if you've further queries.
