house is foreclosure and brother filed bankruptcy

Posted on: 21st Mar, 2013 08:39 am
hi
home in foreclosure since 2008-both names on deed and my brother filed bankruptcy and discharged, i've yet to file. My question is what is his responsiblity ,towards the house and will and can he be compensated if i receive any money from a short sale or from a law suit that i placed against my loan company.
erin
Hi erin,

If your brother has filed bankruptcy and got a discharge from the mortgage on that property, then he is not liable for the mortgage in any way. He has no responsibility. I don't think he needs to be compensated for that property any more.

Thanks

Hi erin,

Yes, it is true that your brother does not have any responsibility toward the property as he has received a discharge from his bankruptcy filing.
