CHAPTER 7

Posted on: 17th Nov, 2010 07:09 am
I FILED CHAPTER 7 IN 2008. MY MORTGAGE WAS NOT INCLUDED IN THE FILING. MY CHPATER 7 LAWYER TOLD ME THAT IF THE MORTGAGE BANK DID NOT REAFFIRM THE MORTGAGE DEBT THAT I COULD WALK AWAY FROM TE DEBT ANYTIME AND THE COURTS COULD NOT TOUCH ME ON IT. IS THIS TRUE?
does anyone have an answer to this question?

Hi JACKIE!

Welcome to forums!

If you haven't included the mortgage in your bankruptcy filing, then you are fully liable for the debt. You will have to pay off the dues on time or else the lender will foreclose the property and you will be liable for the deficient balance resulting from the foreclosure sale.

Feel free to ask if you've further queries.
