My mortgage co had refused to work with me. When I first lost my job I tried to be proactive, called mortgage Ocwen, they wouldn't modify until I fell at least 2 months behind, finally when I did they stalled on 2 modifications each stalled out for over six months, and during this time I tried to make payments that they kept refusing if not paid full. They've attempted to foreclose but had to cancel due to bankruptcy filing. Now, that they've screwed me for over a year, caused me over $40,000 they tapped on in fees and crap, I've come to find out that they don't even hold the note to my home and they tell me the owner of the note does not accept modifications. I have no way of paying these bull crap fees and additional costs that they caused by delaying modifications for a year, my only choice is to move and file ch 7 bankruptcy.
Being that I still own my home, there are several doors that I need and I want to take them before they file foreclosure again. The way I see it is that I am not in foreclosure currently, and what I need to do with my home is my business. I don't have the money clearly to buy new doors or I'd have paid my mortgage. What are your thoughts on that?

If you file Chapter 7 bankruptcy, then they won't be able to file foreclosure against you. They will have to stop all actions against you. While in bankruptcy, you can reaffirm the loan and pay it off as per the payment plan you have. If you don't want to keep the house, then it's better to not reaffirm the loan. In such a situation, you need to contact the lender and surrender the property. As far as I know, you will be able take your personal belongings from the property. Nevertheless, you should contact your bankruptcy attorney and he will help you further in this regard.

We own our first home elsewhere that we have rented and we fear that trying to save this home may cause the bankruptcy trustee to go after our first home, which is the home we intended on moving into after letting this one go. The last renters left the home in shambles so we wanted to take the doors from this current home and let the home go. We do not intend on reaffirming the loan because we do not feel we deserve to pay all the additional fees that the lender tapped on. But we do want the doors.

Welcome to forums!

After you surrender the property to the lender, you should negotiate with the lender in order to find out whether or not you will be able to take away the doors. The lender will let you know whether or not he will accept your request.
