In May 2010, we have our first loan modified (Jumbo loan); however, we have 23 months arrears with second and now it has been charged off. Unfortunately, I am not qualified on the 2 MP program because of the first loan amount is above 729K. I would like to settle on the second, but I paid partial payments on the accrued late payment on the first lien and our eldest son is now attending school at a local university, which increased our monthly budget. Basically, we could not afford to pay a monthly payment on the second. What options do we have in negotiating the second lien ? FYI, second is not turn in to a collection agency ; value of our home is upside down by 35%.

as your account is still with the lender, you should contact him and negotiate so that he would give you a repayment plan to pay off the balance amount. you can even let the lender know about your financial situation and ask him to forgive the second mortgage. however, it would be completely the lender's discretion whether or not he would forgive your balance amount.

Thank you for your kind reply. At this time, she wanted to update our monthly budget. I would take your advise to settle our second, we really do not have the financial wherewithal to pay our second especially the original monthly payment on our first dropped only 100 dollars; however it includes principal and interest, which better than interest only -thank you!
