My in-laws have owned a home for the last 20 years (maybe more) in Florida (part of that time it was owned by the grandmother). Never has anyone disputed the property line until recently. The neighbor, of maybe 5 years, claims that her property line is approximately 3 feet over onto my in-laws property.
In dispute is the back portion of the property with a raised lot with an upper patio which has a 10 ft. drop into the neighbors yard and has combination fence/bushes that runs along it. After my in-laws left to go back to Michigan, the neighbor cut down the bushes and have put up a six foot fence three feet into my in-law property. This includes coming onto my in-laws property and putting that fence 3 ft. onto the upper patio.
My in-laws are in their 80's and are distraught that this neighbor would do this. Is this legal because the neighbor claims she had her property surveyed and she wants her piece of the property back?

Ask the neighbor to produce a copy of the survey. There should also be a copy of the survey at town hall. If your in-laws want to be sure, they can order their own survey which would cost approx $400
and that would be a well-spent $400.
