co-owner going to prison

Posted on: 17th Dec, 2009 03:45 pm
Co-owner is going to prison probably the rest of his life. I don't take pleasure in other peoples pain, however my name is still on deed and loan. What can I do if he doesn't sign off?
Sorry forgot to add I am in Texas.

sign off on what? are you planning on selling, or are you looking to hold title individually?

if you are speaking of the mortgage, all you'd have to do is continue paying.

it's not a pretty picture in any way...what is your intent?

I think I would like to keep property, however his name must be taken off deed. Say in 10 years property paid off, I spent alot of money on the needed repairs and for some reason he gets out. besides him signing his part of property to me is there another way to get his name off?

if you can qualify for the loan by yourself; refinance and remove him from the loan.
