How can I legally make the co-borrower sign a loan modification?

Posted on: 07th Apr, 2010 11:37 am
Co borrower's name is not on the Deed and she has filed for bankruptcy. I am behind in the mortgage and I am trying to do a loan modification but they won't do it without her signature? How can I take legal action?
Hi ambaez!

Welcome to forums!

As the co-borrower's name is on the mortgage, she will have to sign the required documents in order to get the loan modification. However, I think it will be difficult for you to get a modification as your co-borrower has filed bankruptcy. Unless the bankruptcy gets discharged, I don't think the lender will take any steps to modify the loan.

Feel free to ask if you've further queries.
