can collection agency garnish my ssi check i am legal blind

i got a school loan about 19yrs ago they came after me about 2yrs now i have tried to get my doctor to sign form to declare me totally disable he wont scared he might have to go to court so,tried to tell them i am legally blind not able to work have not work since 1992,the service for the blind have not found me work yet so i just get ssi from the goverment to live on the collection agency say they can garnish my disabled check can the do that they have been calling and saying i need a checking account and they need a routing number also,my mother needs help i am trying to consolidate for her totake care of the matter to pay them off but the collection people say she don't want to do that help please,this school loan has went into a federal default,she have had several eye sugery to help my sight but nothing helps she hassever glaucoma it has took over one of her eye so she has lost sight in her right eye and has 2 to 3 feet of sight in her left eye also she had 2 hip replacement and a shoulder repaired so
joyce, the collection agency is lying to you about their ability to attach your check. what they are doing is illegal, in fact.

your social security check CANNOT be garnished. tell them the next time they say that it can that you plan on filing a complaint with the federal trade commission and that you know they cannot do it.

DO NOT give them an account number and the routing and transit number unless you wish for them to take whatever this debt is from your checking account. what they will be able to do (and you need to know this) is to garnish your bank account. they can take the entire balance of what you owe them if it's in your account.
i didn't understand the last part of your post - about trying to consolidate for your mom and "the collection people say she don't want to do that."

i agree with george they cant go after ssi but they might be able to get you bank account

I am 23 and disabled, I am working with a debt management program. They contact my creditors and make a proposal with them and I pay a monthy payment to the debt management program. and they pay my creditors. Can I still be sued if I am making a monthly payment?

Hi Rosemary,

If you are making monthly payments regularly, then your creditors will not be able to sue you. Creditors can garnish your savings account or your wages in case of a default but they won't be able to garnish your SSI checks.

My sisier in law is 87 y.o in a nursing home and has dementia. A collection agency is trying to make her pay for medicine that was ordered by the nursing home. They are trying to collect what her insurance did not pay Can they attach her checking account. All she is is social security and a small monthly retirement check from california. :?:

Probably some oen need to call the collection agency and exaplin your sister in law's situation

Hi sonny,

A collection agency can attach a lien to a savings account but they won't be able to attach a lien to her retirement account or social security income.

MY SSI CHECK GOES IN TO MY CHECKING ACCOUNT. CAN A CRITED CARD COMPANY STILL ATTACH THAT

Welcome AL,

Social security income along with your retirement benefits cannot be garnished by the credit card company. If your credit card company does so, it would be considered as illegal.

true adonis, but al is asking a different question, i believe.

al, if the creditor has an execution against your bank account, any and all monies that are in that account when the execution hits will be taken and awarded to that creditor. the bank holding the account is not liable to determine the source of the funds that are in there, so if you wish to protect your ssi, you'd better open a different account - somewhere else - if that creditor knows where you bank.

if the creditor doesn't know where you bank, then you're probably safe to let it be.

can a collection agency attache your checking account? i owe dr. and hospital bills. my husband and i have ajoint account. i have no income of my own he gets ssand 2 small pensions. he didn't sign anthing to be responsiable for my medical bills.

Welcome to forums!

A collection agency will have to file a lawsuit against you and get a judgment from the court. If the collection agency gets a judgment, then they will be able to place a lien on your checking account.

I just got a summons and complaint today from a hospital i had to admitted like 3 yrs ago and it cost 18,000 and all i have for income is my SSI i'm in michigan and i didn't know if they coulld take it from i have direct deposit but its a prepaid card i just don't know what to do i only bring in 674 a month and i told them before i couldn't pay all my money goes for living expenses and food i even still live with my mom this is scary for me it's the first time anything like this has happened i just want to know what i should do thank you
