My husband bought property in 2005 as an unmarried man, however, I allowed him to link his bank account to mine in order to show ability to pay. It was agreed that we would be co-owners and we were married in 2007. We have a joint account for the purpose of the rental property all of our bills have been paid throught joint accounts and I have been paying for his medical insurance through my employer as he is currently unemployed.
My husband now wants a divorce and wants to exclude me from any rights to the property and is asking me to leave the premises. Should I file or should I wait and let him file for this spontaneous request.

Was your name added to your husband's property? If yes, then you are one of the owners of the property. He cannot force you to remove your name from the property deed. If you want, you can definitely sign a quitclaim deed and transfer the property in his name. Whether or not you should file a case is your discretion but before taking any step you should contact an attorney and take his opinion.
