How can a Bank sell a home that they do not own??House has not been foreclosed on in the process since 2007. HOA going to court fileing Motion to Co.mpel bank has cancelled the foreclosure hearing which I have not and will not go against it. I have see my old home which I gave up all financial claims to in 2007 at a preforeclosure site for sale. I am getting pissed at BOA for not taking home back and I am considering a suit for uttering forget docs

If you've taken a mortgage from BOA, then they can foreclose the property in order to recover their dues. The property may not have sold off in 2007 as they did not get any buyer for it. If the lender gets a buyer now, then he will foreclose it now.

It sounds like you are upset because you walked away in 2007 and the lender has yet to foreclose on the property? Why did you leave the house in the first place? If you couldn't afford it then, and still would not be able to now then what is the point of suing? Simply put, homeowners signed a legal binding contract to make payments, if you do not you loose the right to ownership, this applies to anything in life including your home. Granted lenders do not always play straight but neither do homeowners. Suing isn't going to make you feel any better and all your looking for is money which in the end you would end up spending more than getting any from Bank of America. Sorry but it would be a lost cause and would end up being just another frivolous law suit which we do not need in this country!

Ki for your info my wife had incurred over 500k in medical bills since my insurance was cancelled due to her exceeding life time limits...I utalized all cash and assets we had to satisfy debts but were short. We had about 100k we disolved and tried to pay and make arraingments to pay further no luck was forced in bankrupcy. Could have gone ch 7 but told atty no go ch 13 and payback something which is better than nothing. So for your info you don't have a clue do you???By the way our lender would not even entertain a mortgage motification at that time..
