Protect consumer while reinstatement

Posted on: 03rd Dec, 2012 01:11 am
Are there any laws in place to protect the consumer in the case of a reinstatement on a mortgage with a bank? Was looking through Oregon Revised Statutes 86.753¹ and wondered if that language is meant to protect a person from excessive attorney fees? Does it cap the limit at $1000.00?
You should note that curing the default includes paying off all the fees that have accrued at the time of foreclosure proceeding process. Moreover, as far as I know, charging of reasonable fees so whether or not $1K would cover these fees would vary depending upon at what point you actually cured the debts. You can get past $1K in no time at all and I think you would have a difficult time proving what is or is not reasonable.

Hi Favor!

Welcome to forums!

I will suggest you to get in touch with a real estate attorney of your state and clarify the matter with him. He will be able to help you sort out the matter.

Feel free to ask if you've further queries.
