does my husband have any rights?

my husband co-signed for a loan on his fathers house (my husband is reasponsable for the house payment).over a month ago his dad crossed a line and forced us to leave our home(which we all shared)my husband and i and our four year old daughter are now homeless is there anything we can do? can we make him leave?
AS your father in laws name is also there on the deed you can do little about it to remove him from the property.But you can do one thing that you stop paying the mortgage payments.and automatically the house will be foreclosed if your in laws do not pay for it.

If he pays for it then it is ok and your score will not be lowered.but if he didn't then your score will be lowered as well as the house will be foreclosed.

Sound like a nice DAD.

If your husband's father forced you & your husband & child to leave house & if he still not paying dues of mortgage.As you say your husband is co-signer for loan if he stop to pay dues then lender will automatically foreclosure this house & that time your father will call you for help & all things depending on you if you pay them lender will stop foreclosure & if you avoid to pay them then you & your father both will be homeless.

Hi Kellie,

Is your husband listed on the deed to the property? If he is, he has a right to the property. But if his name is not on the property deed, he does not have any right to the property. Are your in-laws capable of making the payments on their own?

if your husband is on dded, something can be done. otherwise, he can ask his father to refinance the loan

Yes Robert, If her husbands name on deed then he can refinance mortgage as well as he can sign quitclaim deed. To get name on or off to deed.

Second thing is if his name mentioned on deed then his father can't remove them from house by force & then he will take help of attorney.
