we need to evict someone living there that is not on the mortgage..do we have the legal right to do so?
Is there an agreement in place for this person living there? What is the reasoning behind your intentions?

no agreement in place.....she has been living there since Feb and has paid no rent, no electric, no nothing.........this is my daughters house and she is struggling terribly to make ends meet. It is my daughters boyfriends mother...she has done this to other family members and I am afraid we will have to seek legal action to remove her.

Is she on the title to the property? If she is not, then she has no right to stay in the property. If there is no written agreement is place, she cannot be considered as a tenant or a renter. If she does not make any payments towards the mortgage or the house, your daughter has every right to evict her from the property.

I've not seen any of these suggestions coming from legal counsel, and you want to be absolutely certain that you don't violate any laws in your efforts to evict someone.
