Removing a co-signer

How can I Remove a co-signer from my mortgage and take them off the deed?
you cannot simply "remove" someone from a note or deed. with a mortgage, in order to undertake one in your name only when it is currently joint, you are going to need to refinance with a lender. if the property is owned jointly, you would need to come to an agreement with the other party and have the property deeded to you.

my husband filed bankruptcy and the home he jointly owned with his ex was included we moved out of the property and now she moved back into it and is living...his name is still on the deed and we want to collect our half of the equity since we lived and paid the lender for 3 years, she has never made a payment and now wants him to sign a quit claim deed or lawyer suggested we not do this. any suggestions? the only way to get a cosigner off the deed is to refi or sale

Hi amanda,

As the lawyer has suggested that you should not sign the deed and transfer the property, then you should go by his opinion. What type of bankruptcy did you file? If you filed for Chapter 13 bankruptcy, then you can still stay in the property and make the payments according to the payment plan given to you by the lender.
