Loan is in my name only, title both names

Posted on: 27th May, 2010 02:34 pm
Please advise, divorce decree gave here a quick claim to title, both names are now on the title. My name is the only one on the loan. I am in the process of taking her back to court, she is in contempt, she cohabitated (with benies) and then when my PI pinned her down, she immediatley remarried. She now has transferred her interest to the title to someone else. There are many creditors chasing her for money owed to include her divorce lawyer. Can they put a lien on the house for her unpaid debts? What should I do if and when I do get the loan paid before I transfer the title? Who do I get to look the title over to make sure there are no liens on it? I live in Magna UT. Please advise and thank you
Hi rduane!

Welcome to forums!

As your ex has her name on the property deed, she will be considered as one of the owners of the property. Her creditors will be able to come after her for the unpaid dues. If you want to claim full ownership of the property, you will have to ask her to transfer the property to you by signing a quit claim deed. You can contact the county recorder's office in order to find out if there is a lien on the property or not.

Feel free to ask if you've further queries.
