Hi there- I was hoping someone could help point me in the right direction. I am the oldest of 5 siblings, My mom committed sucide this last June she died out out of test ate. She was married. The judge granted her husband to be her PR. My mom had owed a lawyer of her's money before she got married and while she was married. Her husband had no knowledge of her debt with her lawyer. The judge odered her husband to have a estate sale and sell all her things even things that my mom and her husband bought together wile they were married and put the money in account. Using the money from selling her stuff to pay off my mom's lawyer. My mom's lawyer bill I think is 20k and he's been mailing my mom's husband the bill every month adding a $100 a month in interest. My mom's husband has so far made $4k from selling my mom's stuff and his $4 k is barely going to put a dent in the bill. Mom's husband is planning on submitting all his paper work at the end of the month and wait for another court date to see if the judge will still make him responsable to pay the remainder of the bill, he will not be able to if this happens. Could he get in trouble for taking the money from my mom's account and file a full bankrupt? If he tries to do it after his next court hearing and the judge does decides to make my mom's husband pay the remainder of my mom's lawyer bill he will want to file bankrupt but, he will not have the money too! This situation just makes me so upset because this lawyer knows my mom is dead and he's still sending bills with interest. I can't tell u how heart wrenching it is to have me and my siblings, and my mom's husband, to get no closure with a suicide but , also even worse to sell her things, even family hairlooms that have been in the family for 50- 100 years. We have nothing of our mom's to hang onto because of her lawyer wanting to take everything!

You mother's husband can file bankruptcy for his own debts. He won't be able to take money from your mother's estate. You mother's husband should contact an attorney and discuss the whole situation and then take a decision.

He has and his lawyer has done nothing for him but ,prepare his paper work for court. His lawyer has not made a good recomendations for him what so ever and this has been going on since june!
