I am listed as the homeowner and my Dad had lifetime rights. His name was also on the mortgage, but I can't remember if he was a co-signer or second on the mortgage. I have been making all of the payments, even when he was still alive. I told the mortgage company that he had passed away and I believe that I sent a death certificate, as I did everyone else on his behalf. His name is still on the mortgage, I guess I have to assume they never received the death certificate or it "fell through the cracks". I want to do a loan modification on it because I am on unemployment right now and they told me that I may quailfy, but I know there is nothing I can do because his name is still showing on the mortgage. As far as I know he is also still listed as having lifetime rights to the property. What can I do to stay out of trouble with the mortgage company and keep my house? Thanks in advance.

you ought to be able to work with your lender on this modification by providing them (again, if needed) with a copy of the death certificate. they cannot and will not take his name off the mortgage, but that ought not to matter here.
contact them and find out what they need from you and move forward from there.
