If my mother was not a joint account holder on my deceased father's account and can't afford to pay the balance, can the creditors put a lean on my mothers property that she and my dad own? My mother lives in a single family home but also owns an income building. They have mortgages on both homes. They have no other assets. The property is in Illinois.
If your mother's name is not mentioned on the mortgage docs, then the lender won't come after her for the loan dues. However, they can foreclose the property in order to recover the dues.
