Did you ask for an explanation as to why they have declined to modify your loan? Is your income too much for you to qualify for a modification plan? Did you provide them with a hardship letter and a copy of your financial statement?

our loan is with countrywide whi is now bofa, we approached bofa and they said we did not qualify. we are currently 2 months behind. the last talk with bofa was that they are willing to refinance our house however we need to come up with the difference dollar amount of what our loan is and the current valueof our home, which is upside down. who can we talked to about a loan mod?

You will have to contact the customer care department of BofA about getting a loan modification.
