Deed in Lieu

i have been trying to negotiate my husband's 5 loans with bank of america and the loss mitigation department does not want to modify any of his loans because there is still an income deficit at the end of the month. we want to prove to the lender that the properties are not worth what is owed on the mortgages and that rents has also dropped. they say he was to make more money in order to qualify for some type of assistance but they do not tell me what programs they have. we would like to lower the principal balance and or interest rate. doing either one will drop the payments to a more reasonable amount. the next option is doing deed in lieu of foreclosure but they say the homes have to be listed for 3 months. he is already behind 3 months of payments plus another 3 will probably be too late and some properties might go to foreclosure. is this request from the lender accurate. can't we just deliver the property to the lender since they do not want to negotiate?
I would suggest requesting someone else to work on this for you at Bank of America. Ask for a manager in that department and let them know you are not happy with what is going on. Let them know you need to lower your payments by increasing the term, lowering the interest rate, etc. The manager may even be able to help you and come up with a solution that works for you. Also, go over the numbers to make sure they are correct with the manager.

If you choose to give up the property, deed in lieu is an option as is a short sale. You may want to put the property up for sale. When you have an offer, go to Bank of America and present this for them to take a reduced payoff. Many banks are doing this right now.

But again, try Bank of America again before giving up on that option.
