Deed in lieu of foreclosure

i have 2 loans:
1st 135,000. 2nd 31,000.
i thinking of deed in lieu of foreclosure. bank can sell house for 140,000. do i need to pay 2nd loan?

welcome to forums!

you will be liable for paying the second mortgage in full. if the second mortgage lender does not receive his dues, then he can charge off the loan. the account may be given to a collection agency and they will harass you for the payments.

what is the best way for me to give up the house without being harass from collection agency?

Hi sergei,

You can contact your lender and apply for a deed in lieu of foreclosure. If the lender agrees to it, then you'll be able to get rid of the property and you won't be liable for paying the balance dues resulting from the sale of the property. As the balance amount will be forgiven, the collection agency won't come after you.
