Can the mortgage company refuse to do this? Do I need an attorney?

a mortgage company has the rights to refuse a deed in lieu of foreclosure. you can contact an attorney and take his help in negotiating with the lender for a deed in lieu of foreclosure. however, it's always better to negotiate with the lender yourself rather than taking the help of an attorney.
