Deed in lieu of forclosure

Posted on: 19th Sep, 2010 06:20 am
i have been working on a loan mod for several years. i began while the house was rented b/c i was out of town working on graduate degree. the tenants broke lease twice and trashed the house, i fell behind in mortgage payments. wamu(at that time) insisted that i re-occupy the house before they would offer a payment arrangement or loan mod.
since re-occupying, it took a year before they (now chase) offered loan moc b/c of occ intervention. i signed the loan mod docs which were supposed to be final- i was given a 30 yr new mortgage and arrears tagged to end of loan. they reported to occ that they granted loan mod; then told me they were "re-working" loan mod and gave me the new figures over the phone and said i would receive new docs in 2 days. that was 3 weeks ago and now i'm getting the same harrassing calls that i got for the years i waited for them to do something. i am 66 years old and i have had 2 hospital emergency visits with stroke level blood pressure over the stress of this. i can't take anymore, i'm afraid i'll stroke out. how can i get a deed in lieu of foreclosure and just walk away. i have been paying the mortgage all along.
Hi Thelema4,

Welcome to mortgagefit,

I wish I could have been an officer of chase mortgage to intervene in this situation because personally I know how difficult it is to live with stroke problem besides our day to day worries.
In my opinion you should answer those telephones and just tell them that 'your part is over'.You have done everything which is expected from your side and now ball is in chase's court.

So,it might be annoying to answer those calls but it is really worse to avoid them at all.Because more we avoid them, more they try to suck our blood.SO it is better advised that answer all their calls.

Now coming to DIL issue,if you go for DIL that is OK because at this age of 66,I don't think that you will require any line of credit/mortgage henceforth and thus you could be least bothered about credit score.

But in order to go ahead with DIL lender's approval is required so it could be one of the daunting task. What is the situation in area about reality prices? By how many $ you are underwater?

You can even call those officers to whom you have documents for modification and ask/request them to expedite the process.

Feel free to ask any further query if you have
