We had a BK discharged in March 2009 which included our home. We moved out of the home well prior to the BK filing and did not reaffirm the mortgage. We tried to talk to the bank about a deed in lieu after the BK to get them to quit sending us statements but as it was originally a CountryWide load, then converted to BofA, we got lost in the transaction and received a runaround for well over 2.5 years after the BK - Finally got the deed in lieu done last October after BofA delayed us, now we are trying to purchase a home with an early 2009 BK that included the mortgage and we were told that the lender should be going by the BK discharge date but they are saying the 2011 deed in lieu is the start of the wait time. Why are we being penalized for Countrywide/BofA's ineptness at getting the deed in lieu done? We tried to do it all correctly

as the deed in lieu of foreclosure has been reported in 2011, you will have to wait 3-4 years after that in order to qualify for a new mortgage. though it was the lender's fault, there's hardly anything that can be done in this situation.

I agree with Sussane's opinion. As the deed in lieu has been reported by the lender, it will remain in your credit report for the next 7 years like any other negative item and you will have to wait for 3-4 years to qualify for a loan.
