You need not be delinquent in order to qualify for a deed in lieu (DIL) of foreclosure. You will have to prove your financial hardship and put the house on the market for a certain period of time in order to qualify for the deed in lieu. However, it depends on your lender if you can do the deed in lieu without the being delinquent on your mortgage.
