during the ninety day time period of notice of default given by lender , if one's name is not on the loan but on the deed and if one is the spouse of the person who had taken out the loan will the lender consider the option of refinancing the loan or modifying it (if there is no equity in the house) and allowing the spouse on the deed to refinance the loans along with a coborrower? or is there no way that lender will consider modifying anything under a different name?

If there is no equity in the property, then the lender will not refinance the mortgage. It is mandatory for you to have equity in the property to get a refinance.
