Is there any documents that will allow me to purchase my home form my soon-to-be ex - AND- allow him to purchase his own home - without- the divorce being final. We have both per-qualified for our loans, but cannot get to financing and closing without the divorce being final. This will not be until December. We did a self-divorce kit and are not arguing over anything. We just want out and want to move on. Is there any way that I can get financing for my house without the final divorce decree??
if you are not legally divorced yet, then you do not need to supply a divorce decree. what you may need to do is refinance your current residence under your name only. that removes him from that debt. then, his credit will be clear (as far as the mortgage is concerned) and can purchase a new home if he qualifies. then, when you get divorced, he can leave the current home to you.
as far as I'm aware there is no reason that you cannot have separately owned assets while still married. If you can divorce amicably and avoid dispute over the property concerned I don't see why there would be a problem.
If the mortgage is in both of your names at present then you may need to refinance it into your own name, the lender would ned to be satisfied with your persional ability to service the loan however.
