We got a home together and since have split and ready to go through a divorce..during the split he has helped with the mortgage and now things has got ugly..he makes 10 time more than i do and have been making the mortgage payments since the marriage.he feels that since his name isnt on the mortgage he dont need to make payments .is there any way i can get him to help or conti- to make payments before i lose my house..no his name is not on mortgage but he is on the deed
if his name is not on mortgage, he is not responsible for it.

now a lot depends uopn court decision

i trust that you've hired a lawyer to represent you in this divorce. that lawyer needs to be proactive in discussing the mortgage with your husband's lawyer, so that an arrangement can be made, if possible. since his income is so much higher than yours, if you stand to gain any monetary compensation in the proceedings, then i suppose that could include the repayment of the mortgage. but it's up to you to ensure that your lawyer has all the facts and that he/she is working on your behalf to get the assistance you'll need.
