married in Ecuador, want to divorce here (in US)

Two years ago my husband and I got married in Ecuador, now we both live in Georgia (Gwinnett county) but he is scheduled to move back to Ecuador on Dec. 9th and we want to get divorced before he goes. We have no property, children, nothing, it is a cut and dry divorce. My question is, if I file for divorce now and he signs the papers, can the divorce be finalized after he leaves the country? I dont think we will be able to get a court date before Dec. 9th. Also, there is a domestic violence case pending against him right now (me being the victim), does that make a difference?

You can file divorce and he can sign papers, but I don't think the divorce can be finalized after he leaves the country. The case of domestic violence might prolong the process of divorce. However, a divorce attorney is the person who you need to contact in this regard. Someone with expertise in divorce related matters can help you with your issues.

As there is already a domestic violence case in court against your husband I don't think he can go out of the state. What you can do is consult a divorce attorney and file divorce and also discuss with the attorney about the domestic violence case. All the best.
