my husband has just finished divorce, but the haus mortgage was still in his name and was awarded to ex wife..in the court order if ex wife has late pyment at least 1 month or more the proprty is subject for sale in"time strictly of essence"'..ex wife has late payment my husband fail to enforce the sale does this mean my husband has no right to sold the propert if in case ex wife has late or fail payment again?
Welcome deruelbie,

If the divorce decree states that your husband would be able to sell off the property in case if she defaults the payment, then I don't think anyone can bar him from doing so. Your husband should contact his divorce attorney and take his opinion in this regard once again.
