i recently modified my mortgage in July of 09 and there was escrow balance of 7300. I called the mortgage to ask them for the extra cash and they stated and sent a letter that they would send the 4000, after taxes and the new escrow would start for 2010 in 30 days. Thirty days have past and they are now saying because I have received a modification that money was not mine to have and they have applied it to the principal and interest. Is this true............possible and if not is there anything I can do?
Unfortunately, it appears true and posssible.
If you had money in your hands from someone and they owed you money, would you give it back to them anyway??
Not what you are seeking to hear, but, it seems logical to do what they did.
I have no idea if it is legally ok. It would seem to be.

Thanks! you are it is not what i wanted to hear especially they had sent the paper work saying I would receive the money. Just be honest, its not like I had the money! Honesty kinda doesn't exist anymore........oops I forgot!
