I have owned an acre of land along with my siblings since we were children. My father was married to a woman in 1964 and then divorced in 1964. My father had a life estate in the property, along with the ex-wife. My father passed away in 2001 and the ex-wife has never been heard from since 1964. We tried to locate her, but with no success. - We want to evict the person that is on the property, but there is a problem with the ex-wife's name being on the property. We can't locate the ex-wife and no one knows where she is at. She may have already passed away. What do we do ? Can we evict the squatter off the property without the ex-wife's permission?
Welcome docsi,
The ex-wife needs to sign a quit claim deed and transfer the property in order to remove her name from the property deed. As you can't locate her, it will be better if you could contact a real estate attorney and take his opinion in this matter. He will guide you further in this regard.
