Ex entitled to anything?

Posted on: 20th Jun, 2013 12:47 am
Around 3 years ago, my then boyfriend and I bought a house. He contributed toward the down payment but I am making the payments. Since then we broke up. His name is on the mortgage and the title but he is not living in the property for the past 2 years. Is he entitled to anything from this property?
Hi Valery,

If his name is on the property and the mortgage, then he is both the owner of the property as well as liable for the mortgage payments.

Thanks,

Jerry

if you want to drop his name from the property's title, then he has to sign a quit claim deed. alternatively, if you want to get his name removed from the mortgage, then you'll have to refinance it in your name.

Depends whether his name is there on the property deeds or not. If yes, then well he definitely is entitled, otherwise not.
