I was awarded my home in my divorce. He has refused to give me qc deed. He is on the mortgage, not me. He doesnt want to hurt his credit and is trying to force me to sell the home because i cant get refinanced. This is my home and there is very little owed on it
He should have to automatically sign a quick claim deed, but I am not positive as the home was awarded to you in the divorce doesn't sound fair that he is trying to go against that however there are more qualified people here who more than likely have better advice than I do. Also I would try talking to the mortgage company about your options they should also be able to help you out.
hi simonestreet,
as you've been awarded the property in your divorce decree, your husband should sign the quit claim deed in your favor. if he is not doing so, you can take legal actions against him. you should contact a real estate attorney and he would guide you as to what steps you need to take in this regard.
