hi,
in need of some assistance.
Divorced almost 2 years ago. Attorney messed up and worded decree wrong and I didn't catch so ex does not have to re finance. She also quit paying and has ruined my credit.
Just found out she did a loan modification and has made 1st payment on it. I did not sign anything. If I am on the mortgage shouldn't I have to sign and be part of every process or can she do this without me.
2nd- I have tried everything to get off this mortgage and cut all ties but with ruining both of our credit she would not be able to refi and not sure she would get approved for an assumption of loan.
Any advice on what to do to get off mortgage.

If your name is mentioned on the mortgage documents, then you will have to sign the modification documents. You should check out the loan documents to find whether or not your name is mentioned on it. If yes, then you should ask your ex-wife to contact the lender and apply for an assumption. In case the lender agrees to it, then you will be able to remove your name from the loan docs.
