I bought recently purchased $4300 worth of furniture from Ashely''s Furniture and that was back in November of 09 now it. There contract says i am to recieve my furniture 4-6 weeks. It''s now Feb22 and they continue after all this time to postpone my delivery. Now I hear they are waiting til their lease is up and they are going to file bankrupcy. As far as I know they are not a coporate business (not sure). I went to demand a refund and no such luck, they assured me I was going to recieve my delivery in at least 4weeks. Can I take them to small claims and get my money back even if they file bankrupcy or am i out of luck? Please Anyone tell me what I should do!!! I''m sooo lost and I don''t want to be out of money.')

You will have to speak to an attorney in this regard. He will let you know whether or not you would be able to get your money back from Ashleys after you sue them in the small claims court.

a better idea than speaking to a generic attorney is to take this issue to your state's attorney general's office. call them and tell them what's happened; if they have any sense, they'll step in on your behalf and ensure that you either get your furniture or your money back.
How'd you provide the deposit? Cash, check or credit card? Or did you pay them in full. If it was via credit card, contact the company immediately and have it reversed. You'll need to go to court if it was cash or check. Since they've filed for bankruptcy protection, don't believe it when they say it's still going to be delivered. That's a bunch of nonsense.
