can you hire an attorney to force an individual to sell a home, if they do not have the finances to buy you out or cannot refinance the loan due to credit issues?

No one can force an individual to sell the property. It would be considered as illegal. However, if you are one of the owners of the property, then you can file a partition lawsuit with the help of an attorney. The court will order the sale of the property and the mortgage would be paid off first. If there is some extra amount left, then it would be divided amongst both of you.
