We are including our house in the Chapter 7 only because we have a 2nd and 3rd that we can't afford, Our First is current. So, after our chapter 7 is discharged, how long will we have in the house before the bank makes us move? Will they foreclose, Our lender is a no negotiation bank, they had our second and sold it off to an even worse bank who would rather take nothing than negotiate.

If you do not reaffirm the loans and surrender the property to the lender, you will get an eviction notice from him and you will have to leave the property within 3 days after the property is sold off at an auction.

Hi Charlesstanley.

We included a house in a ch-7. How long you will be able to stay in it depends on how long it takes your bank to finalize the foreclosure. Our ch-7 was discharged one year ago and they just finanlized it. I would assume from this point about 30 days. Again, it depends on where your bank is at with the foreclosure process. Typical right now is six months to a year. Hope this helps some. Good luck...we had a bank like that.
