mortgage responsibility

i really need some help!
i am divorced and one of the houses my ex got is in foreclosure and the bank is trying to say i signed the loan.........
i happen to have the originals and i knew i didn't sign for it anyway, they wouldn't accept me because of no income verification bec. i am disabled.

question: i did not sign the mortgage, they said i signed a note making me respons. as well but can not provide it.

they only provided a i-4 family rider and a fixed/adjustabe rate rider which i signed on the original loan i had. there were two loans involved here.

while married there was a title issue and a refinance had to happen which my ex did, it shows my original mortgage getting pd off. the bank refuses to give me the closing papers thinking i dont have them. so is the rider and adjust. rate make me respons??

Welcome to forums!

If you did not sign the loan docs, then your name will not be included in the mortgage docs. In that case, the lender won't be able to come after you for the loan payments. However, if your name is mentioned on the mortgage docs, then you will be liable for the payments. You should show the required documents to a real estate attorney and take his opinion in this matter.

If you signed the mortgage note and if your name is mentioned on the mortgage docs, then you will be responsible for the mortgage payment. You will be considered as one of the borrowers of the loan. If the original mortgage was paid off and the present loan docs does not mention your name, then you won't be liable for the mortgage payments.
