lien on social?

A lawyer called and said "we have file a lien on social"
Does this mean they can garnish my bank account, payroll checks?
This is for an account with a credit card..
I have paid all but this one and another and dont want to file bankruptcy..
ask your attorney for a copy of the credit report or get yourself a copy

you'll see it on the public record section
if it's reporting on 1 bureau then check to see if it has any incorrect information to dispute. You can hire a credit repair company if you dont have the time to do this

garnish - this will depend on your state. Not all states allow lien holders to garnish wages. If you truly have a lien or judgement then you may want to figure out a way to pay them. Some states....they allow the lien to stay for 20 years....10yrs...and another 10 year renewal

Make sure it's a lien/judgement and NOT a regular collection account

Hi Monetaryclipper,

I should first say that nobody is allowed to garnish a social security. Under section 207 of the Social Security Act nobody can garnish social security benefits. However you should contact an attorney who will be able to help you with the details of Social Security and garnishments on it.

and my take, clipper...

whoever called you seems to be threatening. that's contrary to collections law, and the person ought to know better, particularly if it's a lawyer. you can advise that lawyer that they cannot attach your social security income, nor can they threaten to do so (check with the federal trade commission for the full scoop on what creditors can do).

you can cause them lots of trouble by reporting this phone call to the ftc. you may want to alert them to that.

I am in agreement with gmakerley. Clipper, you can complain about the threatening calls to the Federal Trade Commission (FTC). But before you do that you need to check with the FTC rules.
